Traders Applications pending are no guarantee that rights will be granted. You should also realize that it can take from 12 to 18 months before any rights may be granted, and during that time it would be illegal to start any business operations. Consult with the Parkhurst Village Residents Association before you even buy a house with a view to rezoning. They will advise you on the type and degree of opposition that there is likely to be for an application. Remember that Parkhurst is a residential suburb and that this is vigorously upheld by the homeowners. The Parkhurst area which is deemed to be suitable for business operations, whether shops or low key offices, is that part of 4th Ave, between 5th Street and 14th Street. The older Business-1 zoned properties have old established rights but should they be redeveloped, i.e. with increased height etc. then parking has to be provided. It is not permissible that parking be on the street. The more newly developed businesses, whether antique shops or offices are all operating with the consent of the Council – this consent can be cancelled if conditions of establishment are not adhered to. There are also a few scattered areas of old rights – on 1st Ave West and on 5th Ave but again these old rights are conditional upon no significant changes to the buildings. There tends to be a movement now towards converting houses on 6th Street to offices. This is acceptable, because of the nature of 6th Street which is a noisy, busy road, but only within the existing houses and with all parking provided on the sites, and with protective measures such as walls and landscaping on the residential interface. However, any move to extend along adjacent roads will be strenuously opposed by both residents and the PVRA. The best chance for a successful application for a rezoning from Residential-1, (one dwelling per erf) – a normal zoning for a residential property – is to stick to the areas indicated and apply for Residential-1, permitting offices (or whatever) with the Consent of the Council. You will need to provide four (4) / six (6) parking bays on your own premises for every 100sq.m of business area – and must calculate over the entire house if there is no residential element. You will be allowed to use the street or any other business’s parking area. Every resident has the right to use 20% of the existing home to conduct his own business from home and may employ two (2) staff members. The resident must reside in this home. |
